I have been a trusted advisor to the beauty/consumer product, entertainment, gaming, automotive, and association spaces for over two decades. My counsel focuses on the cross section of legal issues that may arise when clients are working to bring their products, services and concepts to market. This work involves considering what intellectual property rights may apply to a product - such as trade secret, trademark, copyright and patent - and what countries the client may have those rights and/or seek to protect/enforce them. Being part of a global firm and relying on a global network of counsel, I work to seamlessly advise on the laws in many countries. I also advise businesses on issues related to counterfeiting and gray market goods. Privacy is equally important and I help my clients ensure their data collection and use is compliant with the laws of the United States, in particular California (CCPA, CPRA), COPPA, New York’s Shield Act, Massachusetts, Virginia (CDPA), Colorado (CPA), Connecticut, Utah as well as FTC guidance. I also assist clients with compliance globally (GDPR, LGPD and PIPL) and I rely upon a global network of counsel to assist efficiently. My work involves drafting policies and disclosures, reviewing consent mechanisms, advising on cross border transfer issues, as well as biometric collection and internal governance systems for data management. I also routinely assist clients with data incidents (preparation and response) and whether notification is required or recommended. Finally, when we are ready for market we consider the unfair competition and advertising issues that could arise. I assist clients with clearing product claims, pricing offers, such as discounts or sales claims, as well as promotions, sweepstakes and contests. I represent businesses in their advertising disputes at the National Advertising Division of the Better Business Bureau. As part of my practice I also routinely review the legal contracts that govern many of these developments and exchanges, including licenses, SaaS/MSA, data protection addendums, coventure, partnership and developer agreements.
